Terms & Conditions of Online Purchases (the “Terms”)

 

These Terms apply to all purchases and orders (“Orders”) of any item for sale (“Product”) made by any customer (“You” or “Your”) using “ifordmanor.co.uk” (the “Website”), which is operated by Cartwright-Hignett Partners, trading under the name of Iford Manor Gardens, (“We”, “Us” or “Our”).

 

Please read these Terms carefully before placing Your Order and print a copy for your future reference.

 

By placing an Order on this Website, You accept and agree to be bound by these Terms, the terms and conditions of use, the privacy policy and any such other policies as We notify You of from time to time, which together constitute the entire agreement between You and Us. Nothing in these terms affects Your statutory rights, whether as a consumer or otherwise.

 

Tickets

Please note the following information before booking:

  • All ticket types must be booked before your intended visit. Iford Manor Gardens operates a policy of no refunds or exchanges for tickets booked online.
  • The session time shown on your garden entry ticket is the time when you are permitted to first enter the garden. If you arrive earlier or later than that time you will be granted access to the garden at our discretion. After entering, you are welcome to remain until the garden closes. All visitors entering Iford Manor Gardens must have a valid entrance ticket. The booking reference and its associated barcode is confirmation of Your booking for the date concerned. You MUST bring Your Admission Ticket with You on the day of Your visit.
  • Iford Manor Gardens has the rare distinction of being just one of 145 Grade 1 registered Park and Gardens in the UK. Visitors should be aware that the Garden is set into a steep hillside, characterised by hidden drops, steep steps, narrow paths and unfenced ponds. It has not always been possible to include a ramped alternative, handrail or seating in all areas of the garden in order to preserve the Grade 1 registered design and setting.
  • Iford Manor Gardens is a place of peace and tranquillity. All visitors are asked to respect this for the benefit of other users and the wildlife that live here. We may require that any visitor (and, where the visitor is a child, the Responsible Adult) whose behaviour is in any way disruptive or dangerous leaves Iford Manor Gardens immediately and without refund of the Admission(s) paid.
  • Children must be closely supervised at all times due to many hazards (unfenced ponds, poisonous plants, hidden drops etc). Please note that children under 10 are not permitted in the garden.
  • No running is permitted in the garden for the safety of yourselves and that of other visitors. Please tread carefully and watch your step.
  • Well behaved dogs on leads are permitted in Iford Manor Gardens. Any dog mess across the Iford Manor Estate must be bagged up and taken home with you.
  • Photographic equipment is permitted in the grounds for personal use only. The resulting material may not be used for any commercial purpose whatsoever including, but not limited to, licencing, selling or in any other way exploiting for gain any images or other material taken whilst on the property. Any commercial photography and/or recording must have prior written permission of the owners.
  • No drones are permitted anywhere on the Iford Manor Estate, except where authorised in writing by the owners.
  • Videography is not permitted in Iford Manor Gardens to preserve the privacy of our other visitors.
  • No food and drink is permitted within the grounds of Iford Manor, except food purchased here to be eaten within the designated area.
  • You acknowledge that you will be liable to us for any damage caused by you to any area of Iford Manor Gardens or to any of its contents or for any injury caused to any of our staff or representatives or to other Visitors during your visit. Visitors must keep to the paths and lawns in the garden and not take any plant cuttings. Without prejudice to the foregoing, you further agree that: (i) where you are the Responsible Adult, you shall also be liable for all children that you accompany; and (ii) where you are the Organiser of a Group, you shall be jointly and severally liable (with the applicable Visitor(s)) for any damage caused by the Visitors in the Group.
  • We welcome Visitors with additional access requirements. Ground limitations and the steep hillside at Iford Manor Gardens mean that visitors with such requirements may be required to use a designated route and our Health and Safety obligations mean that in certain areas the numbers of such visitors at any one time may be limited. Please call us on 01225 863146 or e-mail info@ifordmanor.co.uk in advance of your visit to discuss your access requirements in advance of your visit so we can advise accordingly on applicable access restrictions.
  • The Ticketing System applies to parties of 1-6 visitors in line with Government Guidance. Groups of 15 or more should contact our office directly on info@ifordmanor.co.uk to book a group visit. Our Group Information Leaflet can be downloaded from our website: https://www.ifordmanor.co.uk/groups
  • Possession of the E-Ticketing Booking Confirmation will be regarded as proof of purchase and will entitle you to the relevant number and type of tickets purchased.
  • Credit card transactions are made on a separate secure server with full encryption of all credit card data. Your credit card details and personal information will not be shared with any other company or organisation.
  • Special events may occasionally necessitate restricted access or additional charges to enter Iford Manor Gardens.
  • Iford Manor Gardens reserves the right to close to the public in whole or part, alter times, prices and events or services without notice.
  • We reserve the right in our sole and absolute discretion to refuse admission to Iford Manor Gardens of any person if circumstances reasonably so require and our decision shall be final and binding. We also reserve the right to suspend or cut short a particular visit if circumstances reasonably so require. If the cancellation is through no fault of your own, we shall provide an appropriate refund for your admission to a maximum of the price you paid for your Ticket. We shall not be liable for any additional costs you may have incurred or will incur.
  • Iford Manor Gardens reserves the right to request further identification at the point of entry.
  • Your admission allows access only to the areas of Iford Manor Gardens open on the day and no other rights or permissions whatsoever are conferred by the Admission. Access to other parts of Iford Manor or Iford Manor Estate is prohibited, other than to the cafe and restaurant. Please note that CCTV is operational across the grounds.
  • You agree at all times while visiting Iford Manor Gardens to comply with the Conditions and with any directions given by representatives of the Iford Manor Estate.
  • Except in respect of death or personal injury caused by our negligence or by that of our employees or any other liability that cannot, as a matter of law be excluded or limited: (i) we exclude our liability for any loss, damage, cost or expense suffered by you or occurring to any items belonging to you as a result of your visit; and (ii) our liability to you shall be limited to the price of your Admission. Under no circumstances will we be liable to you or to any third party for any consequential or indirect loss, damage or expense.
  • Without prejudice to the above clause, we will not be liable for any breaches of the Conditions or delays arising from any event outside our control, including (but not limited to) fire, flood, storm, strikes, riots, civil commotion, material disaster, unscheduled State occasions, war or acts of governmental or parliamentary authority.
  • The Ticket is personal to you and may not be assigned, transferred or resold in any manner whatsoever other than in accordance with the Conditions; These conditions: (i) shall not be enforceable by virtue of the Contracts (Rights of Third Parties) Act 1999 by any person who is not a party to them; (ii) apply to all admissions and supersede any earlier conditions and all terms and conditions applying to previous years. All other terms and conditions whether express or implied are hereby excluded to the extent permitted by law. The Conditions may not be waived or amended without our written consent; and (iii) shall be construed in accordance with the laws of England. Any disputes arising under the Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
  • Admission, Tour or Special Event Tickets cannot be purchased or used by any organisation for marketing, promotional or competition purposes without prior written agreement and consent from Us.
  • If We are forced to cancel an event or public open day (due to force majeure, including but not limited to: extreme weather/act of God, flood wind or fire or sudden regulation imposed by Government) and cannot transfer Your Tickets to another date, then refunds for Your Tickets will be available upon request at Our discretion.
  • For technical or operational reasons, some areas or facilities may be removed or closed on the date of your visit.  Additional builds for events may also be in place on the date of your visit.
  • We reserve the right to change any programme of attractions and entertainment, if at any time it is deemed necessary or appropriate to do so.
  • We expect our valued guests to take out normal and appropriate travel insurance to cover any losses should they be unable to travel.
  • We accept no responsibility for personal property or for vehicles parked in the Iford Manor Estate.
  • We are not liable for any other costs, claims or damages including but not limited to consequential loss, such as the inability to visit due to travel disruptions including use of private vehicles and public transport.
  • Without Our express written permission, You may not combine a ticket with any hospitality, travel or accommodation service and/or any other merchandise, product or service to create any form of ticket package (a “Ticket Package”) and offer for sale or sell, or otherwise transfer or facilitate the sale or transfer of a Ticket Package, for profit or commercial gain such a Ticket Package as an incentive or prize in a promotion or competition, or otherwise dispose of such Ticket Package in the course of a business or for charity.
  • No Admission, Tour or Special Event Ticket shall be used for advertising, promotions, contests nor sweepstakes, unless formal written permission is given by Us to You.  Even if such consent is obtained, use of Our trademarks and/or other intellectual property is subject to Our specific prior consent to Your use.
  • We shall have no liability beyond the face value of the Ticket purchased. We are not responsible for any loss of enjoyment or wasted expenditure. Personal arrangements including travel, subsistence and accommodation relating to the visit which have been arranged by You are at Your own risk.

The contract

  • When You place an Order to purchase Products using our Website this is an offer by You to Us to conduct a sale on those items.
  • The contract between You and Us is formed at the point that We send the Confirmation Email in respect of the Products mentioned in the Confirmation Email.

 

Prices

  • Products are invoiced in GBP at the price prevailing at the time You place Your order. Prices displayed on the website include VAT, which will be charged at the current rate. All Tickets for Admission, Tours or Special Events are delivered to you by e-mail and must be brought with you and shown at the entrance to Iford Manor Gardens to gain admission at the agreed date and time. All Products purchased online will be made available to you to collect upon visiting Iford Manor Gardens on the date and time shown on the Ticket that you purchased in the same Order.
  • Prices displayed on the Website apply to online purchases through the Website only. They are not indicative of the price of identical items purchased in Our store or by any other means. We reserve the right to update prices displayed on the website from time to time.

 

Privacy and communications

  • When You place Your Order, We collect certain personal and transactional information (e.g. name, address, email address, credit/debit card details) and You agree We may pass such information to Our partners in order to fulfil Your order. For details on how We use this information, please read Our privacy policy. To fulfil Our obligations to You under these terms We will communicate with You by email and by posting notices on the Website. You agree to receive communications from Us electronically and that electronic communications will satisfy any legal requirement for communications in writing.

 

Alterations to this website and terms

  • We reserve the right at any time to make changes to this website, these terms, the privacy policy and such other policies as We may notify to You. You will be subject to the policies and terms and conditions in force at the time You use the website or order items from the website. Changes which We are required to make by law could apply to orders which you have already made.
  • If any of the terms or conditions forming the contract between You and Us are deemed invalid, void or unenforceable for any reason, they will be deemed severed and/or altered to the minimal extent possible so as to not affect the validity and enforceability of the remaining terms and conditions.

 

Events beyond our reasonable control

  • We will not be responsible to You for any delay or failure to comply with Our obligations under these terms if the delay or failure arises from any cause beyond Our reasonable control.

 

Waiver

  • If You breach these terms and We take no action, We will still be entitled to use Our rights and remedies in other situations where You are in breach.

 

Governing law and jurisdiction

  • These terms are governed by and construed in accordance with the laws of England and Wales. You agree to submit to the exclusive jurisdiction of the English courts.
